A reported child-custody issue ended with the arrest of an off-duty Hays County sheriff’s deputy after he allegedly drove to the scene while intoxicated. Newly released information from the New Braunfels Police Department explains how officers encountered Deputy Rodrigo Dimas Deleon before his July 26 arrest. Police say Deleon arrived while officers were already speaking with the other party involved in the custody matter. He was later taken to a hospital for a blood alcohol test before being booked into the Comal County Jail.

Deputy Arrived While Officers Were Investigating Custody Issue

New Braunfels police were called at approximately 8:15 p.m. to a home in the 700 block of Barbarosa Road for a reported child-custody issue. Officers were speaking with an adult woman when they saw a black Ford F-150 pickup truck arrive at the residence. Police said the driver was the other party involved in the custody matter. That driver was later identified as 37-year-old Rodrigo Dimas Deleon.

According to the department, Deleon showed signs of intoxication while speaking with officers. Police administered standardized field sobriety tests and took him into custody without further incident. Deleon was transported to a local hospital for a blood alcohol test and then taken to the Comal County Jail. 

Deleon Released on $3,000 Bond

Jail records show Deleon was booked July 26 and released the following day. His bond was set at $3,000, which he posted through a surety bond the following day.

Sheriff’s Office Opens Internal Investigation

The Hays County Sheriff’s Office confirmed to The Hawk’s Eye that it was notified of Deleon’s arrest. The agency said Deleon was off duty when the alleged offense occurred and is assigned to its Law Enforcement Support Services Bureau. Its Office of Professional Responsibility has opened an internal administrative investigation that will run concurrently with the criminal investigation. Deleon has been placed on administrative leave with pay pending the outcome.

Deleon Has Served with Hays County Since 2015

Texas Commission on Law Enforcement records reviewed by The Hawk’s Eye show Deleon’s service with the Hays County Sheriff’s Office began Oct. 1, 2015, when he received a temporary jailer appointment. He received a regular jailer appointment June 22, 2016, and has served as a peace officer with the agency since April 1, 2019. State records list both his peace officer and jailer licenses as active. They also show advanced peace officer and advanced jailer proficiency certifications, along with a basic instructor proficiency certification.

Deleon is presumed innocent unless proven guilty in court.
