Are Public Records Being Withheld By The City of Harlingen?

A Texas Public Information Act (TPIA) request was made to the City of Harlingen on its employees:

The request was made on these three employees based upon a previous matter, in which they were involved.

So, what was missing? Their applications, resumes, transcripts, letters of reference, and similar documents. Which the City is required to have, in accordance with Texas Retention Schedule GR-1050-14c

So, where are the documents? Why were they not included in the release? The employees knew the documents could be released, based upon these received TPIA documents:

These documents show the requested records to be in existence:

If they are being withheld, this could be a violation of Texas Penal Code 37.10, Tampering with Government Records.

We have submitted a request for comment from the City and we are waiting to see if they would like us to file a Texas Office of Attorney General (OAG) complaint or if they will release the files.

Previously, in another TPIA request, the City lost its case to withhold records from us, by way of OAG decision.
