A Frisco man has filed a federal civil-rights lawsuit alleging that police officers forced their way into his apartment without a warrant, pointed a Taser at him, and searched his residence despite no evidence of a crime inside the unit. The lawsuit was filed February 5, 2026, in the Sherman Division of the Eastern District of Texas. The case names the City of Frisco, Officer Ryan Shick, Sergeant Stephen Goodwin, and additional unnamed personnel as responsible parties.
The January 23, 2025 Incident
According to the complaint, the incident occurred on January 23, 2025, at the Capitol at Stonebriar apartments, located at 9600 Gaylord Parkway in Frisco. Officers responded to a report from a second-floor resident who said she overheard what she believed to be a domestic disturbance but did not know the apartment number where it was occurring. The filing states officers arrived outside Elvin Turner’s third-floor apartment at approximately 6:24 p.m. Turner was inside with his mother at the time, and the complaint states no domestic disturbance or unlawful activity had occurred in the residence that day. It further alleges officers did not hear any sounds of an ongoing disturbance before knocking. After Turner opened the door, officers asked for permission to enter. Turner declined. The lawsuit alleges that despite his refusal, Officer Shick forced the door open and entered the apartment without a warrant or exigent circumstances.
Taser Drawn, Search Conducted
Once inside, the complaint states Officer Shick drew his Taser and pointed it at Turner. Officers then conducted a search of the apartment. During the search, Turner allegedly attempted to prevent entry into his bedroom and was told he would be arrested for obstruction unless he stepped aside. The filing states the search revealed no injured individuals and no evidence of a physical altercation. It further alleges the actual source of the disturbance was later identified as a verbal argument in a different unit on another floor and that Turner was not involved. The lawsuit claims the encounter caused Turner to fear for his life and resulted in ongoing emotional distress.
Chief’s Apology Referenced in Complaint
The complaint also references a later apology from Frisco Police Chief David Shilson. According to the filing, the chief apologized to Turner and his mother, stating that Turner “was caught up in the middle of something he did not deserve” and that the department “need[s] to do a better job of communicating.” The apology is cited in the complaint in connection with a WFAA news report published in March 2025 regarding body camera footage and departmental changes following the incident.
