Corpus Christi Area DPS Trooper Avoids Criminal Prosecution with TCOLE License Surrender
The Texas Commission on Law Enforcement (TCOLE) received a request from prior Texas Department of Safety (DPS) Trooper Adrian G. Rincon Jr.
The request was dated September 30, 2022. It was sent, per self-admitted statement, to avoid criminal prosecution by the Nueces County District Attorney’s Office.
The request was to surrender his Texas Peace Officer license as it related to submitting employment paperwork to his employer. Rather than the document being signed by a health care provider, prior DPS Trooper Adrian G. Rincon Jr signed the document as the doctor.

On October 4, 2022, prior Texas DPS Trooper Adrian G. Rincon Jr e-Mailed TCOLE the following statement (in part):
During the month of July 2022 [prior Texas DPS Trooper Adrian G. Rincon Jr.] needed a work restriction document from [his] doctor. Despite repeated request[s] [the doctor] did not provide it to [prior Texas DPS Trooper Adrian G. Rincon Jr.]. On July 25, 2022, [prior Texas DPS Trooper Adrian G. Rincon Jr.] filled out the document [himself] and signed it. [Prior Texas DPS Trooper Adrian G. Rincon Jr.] then provided it to [his] employer.

He further states the following in the sworn declaration:
The Nueces County District Attorney’s [O]ffice has agreed not to prosecute [prior Texas DPS Trooper Adrian G. Rincon Jr] for the offense of tampering with a government document ([his] personal Evaluative Medical Status Report – Work Restrictions) that [he] submitted on July 25, 2022 to [his] employer. This report was signed by [prior Texas DPS Trooper Adrian G. Rincon Jr] as the health care provider.

TCOLE Accepts the Prior Texas DPS Troopers Permanent Surrender Request
On October 10, 2022, John P. Beauchamp, Interim Executive Director for TCOLE acknowledged and accepted the prior Texas DPS Troopers request to surrender his peace officer license he had since 2014.
Effective September 30, 2022, [the prior Texas DPS Trooper is] no longer licensed by TCOLE. 37 Tex. Admin. Code 223.13(c),(e)(2014)(Tex. Comm’n on Law Enforcement, Comm’n Rules). [He is] also permanently ineligible to reapply for any TCOLE-issued license. Comm’n Rule 223.13(c)
