June 2022 SAPD Officer Suspension Report

The San Antonio Police Department (SAPD) has released its June 2022 suspension report. SAPD provides the public transparency with these reports. They can only release disciplinary actions where a suspension was adjudicated.

SAPD Officers are protected by Texas Legislature through the Civil Service laws enacted. The SAPD Officers must adhere to the City of San Antonio Fire Fighters’ and Police Officers’ Civil Service Commission Rules.

SAPD Officer Indefinitely Suspended for Allegations of Dangerous Acts Towards Prior SAPD Boyfriend

On November 7, 2021, during the Special Victim’s Unit investigation of SAPD21222959, it was discovered that on April 15, 2021, off-duty SAPD Officer Martha P. Martinez became involved in a disturbance with her then boyfriend off-duty SAPD Officer Philip Ortiz, #0454 at [omitted]. The disturbance, which was recorded on video by a cellphone, shows Officer Martinez allegedly pointing a handgun at Officer Ortiz and then pulling the trigger several times. After pulling the trigger, Officer Martinez racks the slide and pulls the trigger again as she says the gun is unloaded. Officer Martinez’ actions did not conform to the ordinary and reasonable rules of good conduct and behavior and brought reproach and discredit on herself and the San Antonio Police Department when she pointed a handgun at another person and then pulled the trigger in a manner that was unsafe.

SAPD Officer Indefinitely Suspended for Allegations of Domestic Abuse

On January 13, 2022, at approximately 0230 hours, off-duty SAPD Officer Christian A. Harris, # 1196 (EPT) and [omitted], became involved in an argument while at their residence located at [omitted]. During this argument, Officer Harris allegedly punched [omitted] in the face once with a closed fist, causing injury (cuts and lacerations inside mouth/lower lip). Also, [omitted] reported to a Bexar County Sheriffs Deputy (BCSO) that Officer Harris reportedly broke her cell phone during the incident. During review of the body worn camera recording belonging to Deputy Mireles, Officer Harris is heard on body worn camera recording admitting to “smashing” [omitted] phone during the incident (34:45). The Bexar County Sheriffs Office responded to the incident after [omitted] relocated to a neighbor’s residence for help. An on-scene investigation was conducted into the incident by the Bexar County Sheriffs Office, resulting in Officer Harris being arrested and charged with Assault Bodily lnjury-Married/Cohabitation.

Officer Harris’ actions in assaulting [omitted], smashing her phone and then being arrested and charged with Assault Bodily Injury Married/Cohabitation demonstrated a substantial shortcoming. Officer Harris’ actions render his continuance in office detrimental to effective law enforcement and the needs of the San Antonio Police Department. The law and sound community expectations recognize that there is good cause for depriving Officer Harris of his position.

SAPD Officer Indefinitely Suspended for Allegations of Abuse

On January 7, 2022, [omitted] provided information in an affidavit to the Kendall County Sheriffs Office, reporting that her [omitted]-off-duty SAPD Officer Adam L. Franklin-Alonso, #0640 (EPB), on several occasions injured [omitted] including the following instances:

1. On August 22, 2020, Officer Franklin-Alonso reportedly caused a red mark to the right side of [omitted] face, consistent with being struck by an adult’s hand. This alleged incident occurred at [omitted] while Officer Franklin-Alonso was outside with [omitted]. Officer Franklin-Alonso’s actions, which caused injury to [omitted] did not conform to the ordinary and reasonable rules of good conduct and behavior, which brought reproach and discredit on himself and the San Antonio Police Department.

2. On October 20, 2020, Officer Franklin-Alonso repeatedly caused bruises in the shape of a handprint on both of [omitted] arms, while placing him into his bed. This alleged incident occurred at [omitted] alleged Officer Franklin-Alonso advised her that he must have grabbed [omitted] too hard, resulting in marks on his arms. Officer Franklin-Alonso’s actions, which caused injury to [omitted] did not conform to the ordinary and reasonable rules of good conduct and behavior, which brought reproach and discredit on himself and the San Antonio Police Department.

3. On March 31, 2021, Officer Franklin-Alonso reportedly caused a bruise to [omitted] right eye, which subsequently became a black eye. The alleged incident occurred at [omitted] while Officer Franklin-Alonso was outside with [omitted] Officer Franklin-Alonso’s actions, which caused injury to [omitted] did not conform to the ordinary and reasonable rules of good conduct and behavior, which brought reproach and discredit on himself and the San Antonio Police Department.

4. On September 14, 2021, Officer Franklin-Alonso reportedly caused a red handprint to the left side of [omitted] face and neck. This alleged incident occurred at [omitted] while Officer Franklin-Alonso was in the playroom with [omitted] Officer Franklin-Alonso’s actions, which caused injury to his son, did not conform to the ordinary and reasonable rules of good conduct and behavior, which brought reproach and discredit on himself and the San Antonio Police Department.

A criminal investigation was conducted by the Kendall County Sheriff’s Office under Kendall County case #K2101926. The criminal investigation of this incident resulted in an indictment and arrest of Officer Franklin-Alonso.

SAPD Officer Indefinitely Suspended for Allegations of Intoxication

On February 8, 2022, at approximately 18:57 hours, off-duty Officer Rosemary C. Caudillo, was found asleep behind the steering wheel of her personal vehicle on the side of the roadway on SW Loop 410 near Hwy. 16. The officer on scene had DWI Officer Alexander Mena, #1721 (TWI) come to the location to conduct field sobriety tests. After horizontal gaze nystagmus was completed, the rest of the field sobriety tests were refused. Officer Caudillo was placed under arrest and transported to the City Magistrate’s Office where she refused a breath sample and a warrant was obtained for a blood sample. The sample registered an alcohol concentration of .232 BAC, which is above the legal limit of 0.08. Officer Caudillo was subsequently charged with violating Texas Penal Code Section 49.04 Driving While Intoxicated (1st Offense) under SAPD22027278.

Officer Caudillo’s actions of being intoxicated in public view and intoxicated to the point that she was rendered unfit to report for duty demonstrated a substantial shortcoming. Officer Caudillo’s actions render her continuance in office detrimental to effective law enforcement and the needs of the San Antonio Police Department. The law and sound community expectations recognize that there is good cause for depriving Officer Caudillo of her position.

Officer Caudillo brought reproach and/or discredit on herself and the San Antonio Police Department when she was arrested for Driving While Intoxicated.

SAPD Officer Suspended for Removing an Emergency Detention Prior to Completion of Medical Treatment

On or about April 15, 2022, Sergeant Mario Ramirez was notified of a complaint. about an Emergency Detention from an incident. Upon review of the incident, Officer Aguilar removed ED from the hospital while he was still receiving medical treatment and without clearance from medical staff, in violation of the General Manual. Officer Aguilar also failed to complete SAPD Form #62, Injured Prisoner Report, as required by the General Manual. (Ref. SAPD22078698)

SAPD Officer Suspended for Social Media Comments Related to Supervisory Decisions

Sometime between December 5-December 7, 2021, Officer Evan B. Bagley posted the following comment on the Facebook group “Switch 2 An Open”:

“I got kicked off a unit I was at since 2006. Now I am making new friends on patrol. Hard to imagine a $35 parking ticket to an illegally parked car (registered to a female with 2 MC warrants) would bring a captain down at 9pm to lecture me on who Should not be giving tickets. I was then given a direct order prohibiting me form taking any Police Action in the 200 blk of E Houston, Bohanans steakhouse. Must be nice to have a sAPD Captains protection from the law. #Team-corruption.”

This comment brought reproach and discredit on Officer Bagley and the San Antonio Police Department in violation of Rule and Regulation 3.04 (C) (Conduct and Behavior).

Additionally, and again between December 5-7, 2021, Officer Bagley posted the following comment via the Facebook group “Switch 2 an Open”:

“Sounds like Bohanans on E. Houston St in San Antonio But they just call a certain Captain who then comes and tells officer they can’t be in that block unless it’s emergency. Along with threats being kicked off certain Units”

This comment also brought reproach and discredit on Officer Bagley and the San Antonio Police Department in violation of Rule and Regulation 3. 04 (C) (Conduct and Behavior.)

SAPD Officer Suspended for Unauthorized Pursuit

On January 22, 2022, at approximately 12:45 a.m., on-duty SAPD Officer Taylor C.Sanchez, #0149 (WPC) was involved in an unauthorized vehicle pursuit that began at Timber Hill Drive/Huebner Creek Greenway in San Antonio, Texas. Mobile Video Recording from Officer Sanchez’ in-car video and body worn camera footage confirms Officer Sanchez pursued the suspect vehicle after the vehicle failed to stop for a traffic violation.

During the pursuit, Officer Sanchez activated his vehicle overhead lights and sirens and pursued the suspect vehicle for approximately 2 minutes and 20 seconds before alerting the dispatcher. Mobile Video Recording from Officer Sanchez’ in-car video also confirmed the suspect vehicle violated traffic laws when he disregarded numerous stop signs and proceeded straight through an intersection from a right turn lane. Officer Sanchez also violated traffic laws when he disregarded numerous stop signs and proceeded straight through an intersection from a right turn only lane. Officer Sanchez continued to disregard stop signs while transporting the arrested person to the Magistrates Office. Officer Sanchez reported neither he nor the suspect vehicle violated traffic laws during the pursuit (Offense/Incident Report, and 200-OR Report).

Officer Sanchez failed to receive authorization from a supervisor to engage in the vehicle pursuit. Officer Sanchez failed to operate his assigned SAPD patrol vehicle in a safe manner and in compliance with all traffic laws. Officer Sanchez did not complete his reports accurately when he documented that neither he nor the suspect vehicle violated traffic laws.

This incident was documented under SAPD22014433.

Officer Sanchez has received prior discipline for similar violations.

On January 6, 2022, at approximately 4:03 a.m., in the 1000 block of S. General McMullen, San Antonio, TX, Officer Taylor C. Sanchez pursued a suspect vehicle who failed to stop for a traffic infraction, in violation of SAPD General Manual Procedure 620 Subsection .09(B)(l )(a).

Further, at the start of the pursuit, Officer Sanchez failed to immediately notify dispatch to get authorization for the pursuit. Officer Sanchez then failed to disengage the pursuit once notified to do so by his supervisor and by dispatch, in violation of SAPD General Manual Procedure 620 Subsection .08.B.8.

Finally, during the pursuit, Officer Sanchez drove in excess of 100 mph, drove off road to jump a curb on a U-turn and entered intersections against steady red signals without stopping. Officer Sanchez’ failure to operate his city vehicle in a safe manner and in compliance with all traffic laws violated SAPD General Manual Section 200 Subsection 3. 18 (C).

On January 22, 2022, at approximately 12:45 a.m., on-duty SAPD Officer Holvin M. Perez, Jr., # 1611 (WPC) was involved in an unauthorized vehicle pursuit that began at Timber Hill Drive/Huebner Creek Greenway in San Antonio, Texas. Body Worn Camera Footage confirms Officer Perez was the secondary vehicle in the pursuit for approximately 2 minutes and 47 seconds before alerting the dispatcher. Mobile Video Recording from Officer Perez’ in-car video confirmed Officer Perez pursued as the secondary vehicle without activating his overhead emergency lights for approximately 1 minute and 38 seconds and pursued for approximately 1 minute and 14 seconds after activating his overhead lights.

Also, Mobile Video Recording from the involved officer’s in-car video confirmed the suspect vehicle violated traffic laws when he disregarded numerous stop signs and proceeded straight through an intersection from a right turn lane. Officer Perez also violated traffic laws when he disregarded numerous stop signs and proceeded straight through an intersection from a right turn only lane. Officer Perez completed SAPD Form 200-OR and reported, “The suspect vehicle did not make any evasive maneuvers or seemed like it was attempting to flee from the traffic stop.”

Officer Perez failed to receive authorization from a supervisor to engage in the vehicle pursuit. Officer Perez failed to operate his assigned SAPD patrol vehicle in a safe manner and in compliance with all traffic laws. Officer Perez did not complete his reports accurately when he documented that neither he nor the suspect vehicle violated traffic laws.

SAPD Officer Suspended for Working Off-Duty Without Permission

On or about April 21, 2022, Detective Frederick J. Grataski, Jr. was involved in outside employment without an approved work permit. It was also found that Detective Grataski was engaging in outside employment while he was on administrative duty.

SAPD Officer Suspended for Missing Assigned Duty

On or about April 2, 2022, Officer Kenneth Cortez was assigned to work Fiesta and failed to report for his assignment.

Officer Jeffrey T. Pratt was assigned and scheduled to work a Fiesta assignment on March 31, 2022, but he failed to report.

Officer Jacob R. Mata was assigned a Fiesta assignment for April 2, 2022 during the second download period, which was on March 25, 2022. Officer Mata failed to make his assignment.

Officer Kevin L. Bell signed up for Fiesta in POFS and the computer assigned him to an assignment for April 1, 2022. Officer Bell unsuccessfully attempted to cancel the assignment and subsequently failed to show up.

Sergeant Matthew Brown signed up for Fiesta in POFS and the computer assigned him to an assignment on March 31, 2022 at 4:45 p.m. Sergeant Brown unsuccessfully attempted to cancel the assignment and subsequently failed to show up.

Detective Luis Tijerina was assigned and scheduled to work a Fiesta assignment on April 2, 2022, but he failed to report for his assignment.

SAPD Officer Suspended Due to Vehicle Accident or Damage

On or about December 7, 2021, at approximately I: 15 p.m., while on duty and operating a city-owned vehicle at the intersection of N. W. 26th Street and W. Travis Street, Officer David Tobias, Jr. negligently struck a curb and two trees.

On or about February 27, 2022, at approximately 1:37 a.m., while on duty and operating a city-owned vehicle at the intersection of San Pedro Avenue and W. Ashby Place, Officer Cora L. Mainz negligently struck a vehicle.
