On September 28, 2021, a Petition for Mandamus Relief was filed. It named J. Scott Seller, the City Manager of the City of Kyle. The one that makes over $200k a year.
The claim is being made that he has not performed his ministerial duty, as required in Kyle City Ordinance 7.01. The Ordinance states the following:
The city manager shall be the chief executive and administrative officer of the city and shall be responsible to the council for the proper administration of all the affairs and business of the city. The city manager shall be required to: (a)Enforce all state laws and city ordinances, and require compliance with all policies and resolutions.
Since late 2018 or early 2019, the City Manager has been called upon by a citizen to perform his duty; as it relates to one of his subordinates. The subordination is Police Chief Jeff Barnett.
The petition claims Sellers has yet to perform his ministerial duty under the law and provides proof that Barnett violated many municipal and state laws. It also includes numerous policy violations performed by Barnett.
Much has already been published on this platform, and still no proper response to the ministerial duty of the City Manager.

The matters were submitted in two Federal Lawsuits; however, the Federal Court declined issuance of service of those lawsuits. This, leaving the Petition of Mandamus as a valid option for redress of concerns.
