May 2022 SAPD Suspension Report
The San Antonio Police Department (SAPD) has released its May 2022 suspension report. SAPD provides the public transparency with these reports. They can only release disciplinary actions where a suspension was adjudicated.
SAPD Officers are protected by Texas Legislature through the Civil Service laws enacted. The SAPD Officers must adhere to the City of San Antonio Fire Fighters’ and Police Officers’ Civil Service Commission Rules.
Suspended for Missed Weapon During a Search Incident to Arrest
Officer Cody S. Morrison was suspended one day because on or about January 26, 2022, he allowed his prison to enter the City of San Antonio (COSA) Detention Center with a weapon/dangerous object (a black folding lock blade with clip). The weapon/dangerous object was located (inside the waist band of the [arrested person’s] AP’s shorts 2nd layer*) by a detention officer during an intake search.
Suspended for Tossing A Little Bit of ‘Weed’ and Not Placing it in the Property Room
Officer Nathaniel W. Linville was suspended for nine days because on or about November 21, 2021, at approximately 7:30 p.m., the on-duty SAPD Officer, conducted a traffic stop in the 100 block of Dailey and contacted the driver, Daniel Flores.
During the traffic stop, two small plastic bags of a substance believed to be marijuana were found. After the marijuana was found, Mr. Flores was not arrested or issued a citation, the required report was not done, and the property was improperly disposes of.
Officer Linville failed to use sound judgement when possible carcotics evidence was found during the traffic stop, the proper report and actions were not completed, and the substance was improperly disposed of.
In addition, during the above incident, one of the bag’s contents were dumped in the grass at the scene, as captured on body worn camera, and the other was reportedly thrown away in a trash dumpster after the stop was completed. Officer Linville did not place the substance in the Property Room as required and had no authority to dispose of it.
Suspended for Sending an Inappropriate Nude Photo in a Group Text to Other SAPD Officers
Officer Mario Salas Jr was suspended for twenty days because on or about January 20, 2022, at approximately 1730 hours, the off-duty officer, sent an inappropriate photo via text message to a group text consisting of twenty other SAPD Officers from the Central Community Service – S.A.F.F.E Unit (CCS).
The inappropriate photo depicted Officer Salas completely nude, standing in a shower with his genitals exposed. Immediately after sending the photo, Officer Salas self-reported the incident to both his supervisors at the time.
Officer Salas subsequently completed an SAPD Form 200-OR, Officer Response to a Complaint, in which he acknowledged responsibility for his actions, but indicated the photo was sent inadvertently.
By sending a nude photo of himself via text message to tweet other department members, Officer Salas failed to abide by the ordinary and reasonable rule of good conduct and behavior, brining reproach and discredit on himself and the San Antonio Police Department.
Suspended for Missed Drugs During a Search Incident to Arrest
Officer Adam H. Lee was suspended for one day because on or about January 14, 2022, at approximately 2:40 a.m., he transported his prisoner to the detention center, were the intake officer found a small bag containing a brown substance inside the arrested person’s (AP’s) sock when he had the prisoner remove them.
The substance tested positive for heroin. Officer Lee failed to remove the AP’s socks while conducting a search, resulting in contraband being found on his prisoner after being taken inside a secure facility.
Suspended for Running Unneeded Code
Officer Eric Rangel was suspended for three days because on or about January 22, 2022, he was dispatched for an officer needing assistance on a traffic stop where both the dispatcher and the officer at the scene advised him to change his response status from Code 3 to Code 1.
Officer Rangel failed to acknowledge this advisement and continued an unauthorized Code 3 response for several minutes. During the response, Officer Rangel operated his patrol vehicle in an unsafe manner by speeding excessively and disregarding several traffic control devices that by policy requires officer to stop. Officer Rangel also failed to write a supplement report on a felony arrest.
Suspended for Skipping Duty Assignment
Officer Juan R. Garcia was suspended for one day because he committed to work a Fiesta assignment which took place on April 3, 2022 and he failed to report for duty on said date. He was carried in aa an “unauthorized absence from duty.”
Suspended for Getting into an Accident
Officer Mandy R. Flores was suspended for one day because on or about February 14, 2022, at approximately 8:08 a.m., she was involved in an accident with another vehicle. She failed to remain at the scene of the crash and immediately notify a supervisor of the incident.
Julie A Cortez was suspended for three days because on or about March 2, 2022, at approximately 1:06 p.m., while on duty and operating a city-owned vehicle at the intersection of IH10W and Huebner Road, she negligently struck a vehicle.
Suspended for Using Foul Language
Officer Taylor C. Sanchez was suspended for one day because on or about February 18, 2022, he cursed numerous times while talking with an Emergency Detention patient. He had previously received a field counseling regarding his language. He also criticized and made disparaging remarks about SAPD’s Mental Health Unit to a member of the public.
In addition, Officer Sanchez failed to obtain proper time/mileage checks and supervisor approval each time he transported the ED in his patrol car.
Indefinite Suspension for Post-Indictment Warrant
Officer Carlos M. Castro was indefinitely suspended because on or about December 15, 2021, a post indictment warrant was issued for him for the offense of aggravated assault by a public servant (warrant #1783680).
On December 17, 2021, Officer Castro was arrested on this warrant by turning himself in to the authorities. Officer Castro’s actions did not conform to the ordinary and reasonable rules of good conduct and behavior as required by Rule and Regulation 3.04(C).
The criminal matter associated with the above facts was investigated under SAPD20011763
Officer Thomas H. Villarreal was indefinitely suspended because on or about December 15, 2021, a post indictment warrant was issued for him for the offense of aggravated assault by a public servant (warrant #1783683).
On December 17, 2021, Officer Villarreal was arrested on this warrant by turning himself into the authorizes. Officer Villareal’s actions did not conform to the ordinary and regular rules of good conduct and behavior as required by Rule and Regulation 3.04(C).
The criminal matter associated with the above facts was investigated under SAPD20011763.
Suspended for Negligent Search Procedures
Sergeant Kevin S. Nogle was suspended for thirty days because on or about April 8, 2021, he was assigned and assisted with a consent search at 1635 Miners Gap, San Antonio, Texas. During such assignment a clear gallon size bag containing approximately four to eight ounces of suspected marijuana was found in the refrigerator freezer.
Sergeant Nogle opened the bag and the contents allegedly spilled into a sink containing liquid, located in the kitchen area. The suspected marijuana was not retrieved, but instead it was disposed of down the sink by Sergeant Nogle.
Sergeant Nogle’s actions initiated a criminal investigation for the act of Tampering with Evidence. Sergeant Nogle’s actions did not conform to the ordinary and reasonable rules of good conduct and behavior and/r brought reproach and discredit on himself and the San Antonio Police Department.
He further failed to use sound judgement when he failed to promptly report the incident to his chain of command and notify them that he caused evidence to be destroyed.
