Palm Valley Police Chief Slated for Trial in 2023

Alvaro R. Garcia, whom is still employed by the City of Palm Valley as their Police Chief, was indicted for three counts of government records tampering. Each count is a state jail felony.

He was initially indicted on or about November 28, 2018. On January 19, 2019, the Palm Valley Police Chief plead “not guilty” to the allegations.

The first continuance was requested on February 14, 2019, and the trial was reset to April 8, 2019. A motion to quash was filed and the case got reset again. On May 16, 2019, a hearing on the motion to quash was heard and a motion to amend the indictment followed. The trial got reset to September 19, 2019.

A hearing on September 12, 2019, resulted in a continuance issues. The matter was set for trial on November 21, 2019. On the anticipated trial date, the court granted another continuance and the matter was reset to March 31, 2020. On February 4, 2021, an email sent from the Palm Valley Police Chief’s attorney resulted in a new trial date of May 13, 2021.

On May 13, 2021, another continuance was granted and trial was set for August 30, 2021. On August 26, 2021, another continuance was granted and trial was reset to September 16, 2021.

The State Asks for a Continuance

After a flurry of defense requests for continuances, the State requested on on September 15, 2021. The court reset the matter to October 4, 2021.

With no indication to who requested a continuance on October 4, 2021, the matter was reset to January 24, 2022. However, the entries of the court from October 4, 2021 through March 24, 2022, are not publicly displayed in the public records portal. On March 24, 2022, both sides agreed to a continuance and trial was rest to June 13, 2022.

Again, a period of time is missing from the public records portal (March 25, 2022 through August 9, 2022) and an announcement was set for August 10, 2022.

The Defense Begins to Ask for Continuances Again

On August 10, 2022, the Palm Valley Police Chief’s attorney requested another continuance and trial was reset to October 24, 2022. The public records portal shows another gap from October 13, 2022, through January 10, 2023.

Both Parties Announce They are Ready for Trial

On January 11, 2023, both parties announce they are ready for trial and the court sets trial for January 23, 2023.

Between January 12, 2023, and January 20, 2023, many motions were submitted by the Palm Valley Police Chief’s attorney. And on January 23, 2023, the State made objection to the Palm Valley Police Chief’s request for another continuance. However, the court did grant the continuance as a “preferential” setting. The new trial date is scheduled for February 6, 2023.
