SAPD October 2022 Suspensions

The San Antonio Police Department (SAPD) has published the suspensions issued for September 2022. SAPD Officers fall under the Local Government Code 143, as it relates to what is considered disciplinary action and releasable to the public.

SAPD Officer Indefinitely Suspended

On April 10, 2022, at approximately 1450 hours, the complainant made a police report at the Northwest Patrol substation for sexual assault. The alleged incident occurred on October 12, 2021. at approximately 2100 hours, in an apartment at [omitted]. The complainant said she agreed to meet off-duty SAPD Officer Adrian Salazar, #1338 (NPB), who picked her up in his vehicle and took her to the apartment. They had been communicating online, and this was their first in-person encounter. The complainant alleged Officer Salazar provided alcohol and the intimacy progressed. The complainant said Officer Salazar touched her breasts and buttocks, and she told him to stop. She said he took her clothes offand she didn’t want him to perform oral sex on her, but he got angry and did it anyway. The complainant said Officer Salazar digitally penetrated her vagina and he begged her to let him have sexual intercourse with her, as he rubbed his penis on her vagina. She told him no, and he stopped. The complainant said during the encounter, Officer Salazar told her “What if I just do it?” and she told him that would be “rape.” The SAPD Special Victims Unit conducted a criminal investigation of the reported sexual assault under SAPD22074656.

On April 10, 2022, at approximately 1450 hours, the complainant made a police report at the Northwest Patrol substation under SAPD22074656. The alleged incident occurred on October 12, 2021, at approximate!y 2100 hours, in an apartment at [omitted]. The complainant said off-duty SAPD Officer Adrian Salazar, #1338 (NPB) picked her up in his vehicle and took her to the apartment. They had been communicating online, and this was their first in-person encounter. The complainant alleged Officer Salazar provided alcohol to her, having full knowledge that she was twenty years old. She said they previously had numerous discussions which covered her age, and she reported Officer Salazar had wished her “Happy Birthday” on her 20th birthday in June. The complainant said she questioned Officer Salazar about her consuming alcohol with him because ofhisjob, and she said he told her he “didn’t care” about underage drinking.

The alleged incident occurred on December 8, 2021, at approximately 2130 hours, in an apartment at [omitted]. The complainant said off-duty SAPD Officer Adrian Salazar, #1338 (NPB) sat outside her residence in his vehicle until she agreed to come out. She said she felt “intimidated” and accompanied him to the apartment at the above address. They met online, and this was their second in-person encounter. The complainant alleged Officer Salazar provided alcohol. The intimacy progressed and she used body language to let him know she wasn’t interested, but didn’t say anything because she was “too scared.” She described Officer Salazar as “more intense” and said he “pinned” her down on the bed to perform oral sex on her. The complainant said Officer Salazar digitally penetrated her vagina and she told him it hurt, but he continued. The complainant said she “didn’t want to do it,” but Officer Salazar engaged briefly in sexual intercourse with her. She told him it “hurt” a second time, and he allegedly told her she was being “dramatic.” The complainant said she believed Officer Salazar discontinued intercourse because of the sounds of pain she was making. She said she turned away from him and eventually he took her home. The SAPD Special Victims Unit conducted a criminal investigation o f the reported sexual assault under SAPD22074656.

The complainant alleged Officer Salazar provided alcohol to her, having full knowledge that she was twenty years old. She said they previously had numerous discussions which covered her age, and she reported Officer Salazar had wished her a “Happy Birthday” on her 20th birthday in June. The complainant said she questioned Officer Salazar about her consuming alcohol because of his job, and she said he told her he “didn’t care” about underage drinking.

Officer Salazar’s actions render his continuance in office detrimental to effective law enforcement and the needs of the San Antonio Police Department. The law and sound community expectations recognize that there is good cause for depriving Officer Salazar of his position.

Officer Salazar was given an indefinite suspension.

On May 18, 2022, warrant #W2220062 (ENGAGING IN ORGANIZED CRIMINAL ACTIVITY) was issued for SAPD Detective Leroy Medlin, Jr., #2386 (SPB) for his involvement related to an incident that occurred in Loving County, Texas. On May 20, 2022, Detective Medlin was arrested for the active warrant obtained by the Texas and Southwestern Cattle Raisers Association Rangers. Detective Medlin’s actions did not conform to the ordinary and reasonable rules of good conduct and behavior and/or brought reproach and discredit on himself and the department when a warrant was issued in which he was arrested.

Detective Medlin’s actions render his continuance in office detrimental to effective law enforcement and the needs of the San Antonio Police Department. The law and sound community expectations recognize that there is good cause for depriving Detective Medlin of his position.

Officer Medlin was given an indefinite suspension.

SAPD Probationary Officer Separated from Employment

Based on [Probationary Officer James Brennad’s] recent performance during [his] probationary period, it has been determined that [he has] not met the fundamental requirements to be a San Antonio Police Officer.

SAPD Officer Suspended for Failing to Follow Pursuit Policy

On April 30, 2022, at approximately 2109 hours, on-duty SAPD Officer Adam H. Lee, #0743 (TWI), driving an emergency vehicle, activated his emergency lights and attempted to initiate a traffic stop in approximately the 3000 block of the US Highway 90 West eastbound frontage road, San Antonio, Texas, after he observed a 2006 Honda Civic, driven by Ms. Vangie Uvalle, being operated without any tail lights illuminated during the nighttime in violation of the Texas Transportation Code. Officer Lee was close behind Ms. Uvalle’s vehicle, utilizing both his emergency lights and siren, as Ms. Uvalle took evasive actions to include making multiple lane changes, weaving around vehicles on the highway and increasing her vehicle’s speed. Despite Ms. Uvalle taking these evasive actions, Officer Lee, without the immediate authorization of a supervisor, allegedly pursued Ms. Uvalle’s vehicle for a traffic infraction. Officer Lee subsequently deactivated his emergency lights at approximately 2113 hours in approximately the 6900 block of IH 35 South, thus terminating the alleged pursuit. At approximately 2113 hours, Officer Lee discontinued his efforts to stop Ms. Uvalle’s vehicle. Officer Lee initiated a traffic stop and conducted an unauthorized pursuit in violation of department policy procedure 620 section .09 B(l)a.

On April 30, 2022, on-duty SAPD Officer Adam H. Lee, #0743 (TWI), was involved in an alleged pursuit of a 2006 Honda Civic driven by Ms. Vangie Uvalle. Following the termination of the alleged pursuit, Officer Lee, without the authorization of a supervisor, continued to follow Ms. Uvalle’s vehicle from approximately 2113 to 2132 hours. While following Ms. Uvalle’s vehicle, Officer Lee failed to adhere to traffic laws, to include allegedly reaching vehicle speeds of up to 103 miles per hour, and disregarded multiple traffic control devices. Officer Lee, following the termination of an alleged pursuit and without the authorization of a supervisor, continued to follow a vehicle, in violation of department policy. On April 30, 2022, on-duty SAPD Officer Adam H. Lee, #0743 (TWI), attempted to initiate a traffic stop on a 2006 Honda Civic driven by Ms. Vangie Uvalle for a traffic violation. Ms. Uvalle took multiple evasive actions and did not stop for Officer Lee, who may have initiated an alleged unauthorized pursuit of Ms. Uvalle’s vehicle. Officer Lee subsequently deactivated his emergency lights at approximately 2113 hours, thus terminating the alleged pursuit. Following the termination of the alleged unauthorized pursuit, Officer Lee, between approximately 2113 and 2132 hours, allegedly exceeded the posted speed limits on roads which he traveled, to include traveling at speeds of up to 82 miles per hour in a 60 mile­ per-hour zone in the main southbound lanes of IH 35 South, at speeds of up to 103 miles per hour in a 60 mile-per-hour zone in the main northbound lanes of IH 35 South, at speeds of up to 85 miles per hour in a 65 mile-per-hour zone in the main eastbound lanes of IH 10 East and at speeds of up to 99 miles per hour in a 70 mile-per­ hour zone in the main southbound lanes of NE Loop 410. In residential areas near the intersection of South WW White Road and Rigsby Avenue, Officer Lee allegedly disregarded approximately nine stop signs and traveled at speeds of up to 46 miles per hour in a 30 mile-per-hour zone on a residential street. These vehicle speeds are supported by Automatic Vehicle Locator ( A L ) records.
Officer Lee failed to operate his city vehicle in a safe manner and in compliance with traffic laws, in violation ofrule 3.18(C).

On April 30, 2022, on-duty SAPD Officer Adam H. Lee, #0743 (TWI), was involved in an alleged pursuit of a 2006 Honda Civic driven by Ms. Vangie Uvalle. Following the termination of the alleged pursuit, Officer Lee continued to follow Ms. Uvalle’s vehicle from approximately 2113 to 2132 hours, when Ms. Uvalle eventually stopped her vehicle and was taken into police custody. Body-worn camera audit trails indicated Officer Lee failed to activate his body-worn camera in a timely manner. Officer Lee is seen activating his body-worn camera at approximately 21:39:58 hours while speaking with Ms. Uvalle, who wasdetained in the back seat of a police vehicle. Officer Lee failed to begin recording with his assigned Body Worn Camera upon initiating a Traffic Stop and subsequent alleged Vehicle Pursuit with Ms. Uvalle. Officer Lee failed to begin recording with his assigned Body Worn Camera upon initiating a Traffic Stop, and subsequent alleged Vehicle Pursuit with Ms. Uvalle in violation of procedure 410.06 D(2)(c).

The above incidents were handled under case number SAPD22091050.

Officer Lee agreed to a thirty day suspension.

SAPD Officer Suspended for Unprofessional Conduct

On May 17, 2022, SergeantMarioRamirez,#3038(EPA) called the Internal Affairs office and advised [omitted] found a vulgar picture and statement written on his mailbox in the East Patrol substation roll call room located at 3635 E. Houston Street, San Antonio, Texas.
[omitted] came to the Internal Affairs office and provided a sworn statement. [omitted] advised in his written statement a drawing of what appeared to be male genitalia and the phrase “Eats Bones” was written next to his name. An investigation ensued and it was
determined Detective Jason B. Macias, #2156 (formerly Officer.#0560) had drawn the picture of male genitalia and written the phrase on [omitted] mailbox in the roll call room. Detective Macias admitted he had drawn the image of the male genitalia and wrote the phrase “Eats Bones” on [omitted] mailbox when Detective Macias answered written interrogatories about the incident as a non- respondent.

Detective Macias agreed to a three day suspension.

SAPD Officer Suspended for Policy Violation

On August 31, 2021, at approximately 6:39 p.m., SAPD Officer Randall A. Baker, #0210 (SCB) and another officer were riding as a two-officer unit in which officer Baker was the driver, conducted a traffic stop at Kazen Drive and Autumn Lane in Kirby, Texas. Officers on scene arrested three occupants in the vehicle during the incident for felony charges of Possession of a Controlled Substance. During a search incident to arrest, body-worn cameravideo footage captured a locked firesafe was discovered inside the vehicle. Officer Baker broke the firesafe open and discovered a large amount of U.S. currency contained in a pink and black floral make-up style purse. Officer Baker handed the other officer the purse, which that officer placed in the pocket of the passenger door of their patrol vehicle.
Despite knowing it was a felony arrest, Officer Baker failed to document his actions in a report. Officer Baker also failed to document in a report the large amount of American currency he found during the incident.

Officer Baker muted his body worn camera without a supervisor’s approval prior to the event concluding. (Refer to SAPD 21/171730).

Officer Baker agreed to an eight day suspension.

On or about August 6, 2022, Officer Samuel L. Martinez received a call for an assault under case number SAPD22168954. Officer Martinez had report responsibility for the call, but failed to complete an offense report, as required. Officer Martinez also failed to activate his bodycam prior to arriving at the scene of the call, as required.

Officer Martinez agreed to a one day suspension.

On or about May 28, 2022, Officer Rick Martinez had a female juvenile under arrest who later escaped. During the prisoner
transport, Officer Martinez failed to handcuff the prisoner while transporting her in a police vehicle, and Officer Martinez did not have a second officer physically ride with him in the same patrol car, which contributed to the prisoner escaping. Furthermore, Officer Martinez did not have his primary or intermediate weapons on his gun belt, in violation of procedure.

SAPD Officer Suspended for Traffic Accident

On or about June 9, 2022, at approximately 3:40 a.m., while on duty and operating a city-owned vehicle at the intersection of NW Loop 410 and Palatine Drive, Officer Bianca G. Garcia negligently struck a tow truck

Officer Garcia agreed to a three day suspension.

On or about July 27, 2022, at approximately 4:55 a.m., while on duty and operating a city-owned vehicle in the 8000 block of N. New Braunfels Avenue, Officer Jorge Patino negligently struck a fence.

On or about July 13, 2022, at approximately 5:51 a.m., while on duty and operating a city-owned vehicle in the 2000 block of U.S.
Highway 90 W., Officer Luis F. Rodriguez negligently struck a vehicle.

On or about June 25, 2022, at approximately 9:30 p.m., while on duty and operating a city-owned vehicle in the 100 block ofN.
Loop 1604 W., Officer Jeremy S. McGuire negligently struck a pole.

On or about July 26, 2022, at approximately 3:43 p.m., while on duty and operating a city-owned vehicle in the 200 block of Holmgreen Road, Officer Jamal C. Johnson negligently struck a metal sign.
