Several students were discovered consuming alcohol at Pieper High School, raising concerns about a Bexar County Deputy Constable’s response.
Bexar County Deputy Constable Suspended Over Alcohol Incident at Pieper High School
At approximately 8:04 p.m. on September 22, 2023, an off-duty event at Pieper High School took an unexpected turn when several students were discovered consuming alcohol in the stadium’s home-side bleachers. The incident has raised concerns about the response of Daniel Baker, a Bexar County Deputy Constable for Precinct 3.
While on duty at Pieper High School’s Homecoming Football Game, two assistant principals, Delayna Doege and Eric Evans, noticed suspicious behavior among a group of four students. The students were passing around a clear plastic 7-11 cup filled with an unknown red liquid. Upon investigating, Doege and Evans identified the liquid as alcohol after smelling the contents.
The administrators then approached Deputy Baker for assistance. Doege reported that Deputy Baker’s reaction was inadequate. After being informed that the cup contained alcohol, Deputy Baker merely sniffed the cup, stared at Doege, and took no further action. Perplexed by his lack of response, Doege took the cup back, photographed the students’ identification cards, and escorted them out of the stadium. She later reported the incident to Corporal Ariel Castillo.
At approximately 8:12 p.m., Corporal Castillo and Sergeant Alfonso Padilla, who was contacted via phone, confronted Deputy Baker to understand his inaction. Deputy Baker claimed he was uncertain about the appropriate course of action and assumed the administrators wanted him to confirm the cup contained alcohol. He also believed the incident would be handled administratively, hence did not detain the juveniles, contact a supervisor, or activate his body-worn camera.
During their investigation, Corporal Castillo and Sergeant Padilla retrieved the discarded cup from a trash can near the visitor’s exit. The strong odor confirmed the presence of alcohol.
In a written statement provided on September 25, 2023, Doege detailed the events, emphasizing Deputy Baker’s passive response. Evans corroborated her account, adding that Deputy Baker showed no intention of detaining the students or escalating the matter. Both administrators took proactive steps by photographing the students’ IDs and removing them from the premises.
Surveillance footage reviewed on September 25, 2023, showed an unidentified male handing the clear 7-11 plastic cup containing alcohol to the students through the southside fence area. The footage also corroborated the administrators’ observations but did not capture the interaction between Deputy Baker and the administrators due to camera placement.
Deputy Baker, who had received four prior verbal counselings since December 17, 2021, for various incidents such as violating a policy, attendance, and insubordination, elected to forfeit two days of vacation in lieu of being suspended. The incident was finalized on October 19, 2023.
