Cameron County Sheriff’s Office, Chief Deputy Files 1 Lawsuit on His County Commissioners
Robert Garcia, currently employed by the Cameron County Sheriff’s Office as the Chief Deputy, has filed a lawsuit on the Cameron County Commissioners Court. The lawsuit is filed in the 404th District Court in Cameron County, Texas. It is provided cause 2022-DCL-03157.
The lawsuit seeks a writ of mandamus and/or injunction to compel an agency to perform a ministerial duty or to correct an abuse of discretion.
The lawsuit seems to be an attempt for the Garcia to have Cameron County pay for lawsuits during a time the County indicated he was not an employee; although, he appeared to act like one. The employment activities of Garza were documented in Federal Deposition on the Cameron County Sheriff, Eric Garza.
Chaplin Files Lawsuit on Cameron County Sheriff’s Office
On March 17, 2022, Adam M Gomez, Jr, filed a Federal lawsuit on the Cameron County Sheriff’s Office. In the lawsuit, Gomez claims he was employed by the Cameron County Sheriff’s Office from September 2015 through the summer of 2021. He claims to be a non-denominational Chaplin and worked 40 hours a week for the spiritual needs of all detainees.
Gomez claims, on or before April 15, 2021, which is around the time Garcia became an official employee with the Cameron County Sheriff’s Office, he felt his days at the Sheriff’s Office were numbered.
Gomez claims he was separated from employment on July 23, 2021. The date mentioned is a date Garcia was official in the role as Chief Deputy for the Cameron County Sheriff’s Office.
In the lawsuit, styled Gomez v. Garcia, et al, and filed in the United States District Court for the Southern District of Texas, Brownsville Division, Gomez claims age discrimination, American with Disability Act, Family Medical Leave Act, Religious Discrimination, Freedom of Religion, Freedom of Association/Retaliation, Libel and Slander, Tortious Interference with Contract by Catholic Dioceses of Brownsville, and Tortious Interference with Prospective Business Relationship by Catholic Dioceses of Brownsville.
The Cameron County Offers to Represent the Chief Deputy in the Lawsuit
On April 14, 2022, Daniel N. Lopez, a Litigation Counsel for the Cameron COunty Commissioners Court, Civil Legal Division, sent an email to Garcia. The email identified the lawsuit filed by Gomez and indicated Garcia would be able to be represented by the County if he elects too.
The letter went on to detail matters where representation may not be allowed, or could be terminated.
Now the Chief Deputy Wants the Cameron County Commissioners Court to Pay for All His Lawsuit Defenses
Garcia is claiming the Commissioners Court acted “ultra vires” or outside of legal authority when it declined to offer legal representation to Garcia when he was not documented by Cameron County Human Resources, as an active and paid employee.
He raises several claims to why he should be reimburse for legal services during the period of time he was not employed by the Cameron County Government.
He even raises the Courthouse Security matter where Juan A. Gonzalez, a Litigation Counsel for the Cameron County Commissioners Court, Civil Legal Division, was not allowed to represent the Cameron County Government in the matter.
The Courthouse Security matter was decided based upon an agreement by both parties. Essentially, the arising conflict was resolved informally and a judicial decision was not needed.
