On August 20, 2021, San Marcos CISD Coach Kurtis Kloiber was arrested for driving while intoxicated by the San Marcos Police Department. Following his arrest, Kloiber was released on a $3,000 personal recognizance bond.

Almost a year later, on July 21, 2022, the Hays County District Attorney’s Office formally charged Kloiber with DWI. The case saw significant legal maneuvering, with Kloiber’s defense team attempting to suppress key pieces of evidence, including blood alcohol analysis and video footage of the incident.

Despite these efforts, on July 6, 2023, the Hays County District Attorney’s Office agreed to a plea deal, modifying Kloiber’s charge to obstructing highway passages, still a Class B misdemeanor. Kloiber pleaded no contest to the revised charge.

San Marcos CISD Attempts to Withhold Records

The handling of Kloiber’s case has been shrouded in controversy. Attempts to obtain records from San Marcos CISD were met with resistance, as Chief of Communication Andrew Fernandez blocked the release of information, prompting a complaint to the Texas Attorney General’s Office. The complaint cited potential violations of the Texas Public Information Act (TPIA).

When the records were finally released on May 14, 2024, they included a statement from Kloiber. He explained that he had been drinking to celebrate a birthday and was attempting to give someone a ride home when he was arrested. The school district required Kloiber to complete a brief statement about what he had learned from the incident and to pledge adherence to the educator code of ethics.

Despite the legal turmoil, San Marcos CISD chose not to discipline Kloiber further, stating that they considered the matter resolved. The district’s decision not to take action against the coach, despite his arrest and subsequent legal proceedings, has raised eyebrows, leading to questions about the district’s transparency and accountability.

The incident underscores the ongoing challenges of balancing legal processes, public transparency, and institutional accountability within educational settings.
