Wilson County Deputy Separated for Misconduct 1 Day Before DWI and Weapons Arrest

A Wilson County Sheriff’s Office patrol deputy was separated from employment on December 23, 2025, following a sustained administrative misconduct investigation, one day before he was arrested on driving while intoxicated and unlawful carrying of a weapon charges, according to records obtained by The Hawk’s Eye. The separation, documented in filings with the Texas Commission on Law Enforcement (TCOLE), was based on workplace misconduct and insubordination and was not connected to the later DWI arrest.   

Separation and Sustained Misconduct Findings

A TCOLE Misconduct Investigation Report (MIR) filed by the Wilson County Sheriff’s Office shows that Rolando A. Garza was terminated following sustained findings of administrative misconduct. The investigation concluded on December 2, 2025, and termination was imposed as the disciplinary action, with Garza’s service appointment ending December 23, 2025. 

The MIR documents two sustained allegations. Investigators found that Garza created a hostile work environment, confronting coworkers in person and sending hostile and profanity-laced text messages to multiple employees. Written complaints from affected employees were submitted and reviewed during the investigation. Investigators also sustained allegations that Garza repeatedly failed to follow lawful orders and was insubordinate to supervisors, including refusing to sign disciplinary acknowledgments on multiple occasions. The report concludes that this conduct violated Wilson County Sheriff’s Office Policy 319 governing standards of conduct and directives. 

Escalating Discipline Throughout 2025

Internal disciplinary records show that Garza’s termination followed nearly a year of escalating discipline. Records reflect verbal counseling as early as January 20, 2025, followed by additional verbal counseling on July 1, 2025, for similar issues involving failure to comply with supervisory directives. 

A July 24, 2025 disciplinary action formally documented Garza’s failure to comply with a lawful order issued by a supervisor. That action cited Policy 319 and warned that continued non-compliance could result in more serious discipline. Less than three weeks later, a second disciplinary action dated August 13, 2025 documented an incident in which Garza was described as disrespectful and argumentative toward his supervisor. According to the report, Garza refused to sign a counseling statement, stood up during the meeting, exited the office after being told the discussion was not over, and slammed the door. 

Body-Camera Violations and Supervisory Concerns

Supervisory memoranda attached to the disciplinary file provide extensive detail regarding repeated body-worn camera violations. Supervisors documented multiple occasions in which Garza arrived for duty with an uncharged body camera, left his camera in the docking station while off duty despite explicit instructions not to do so, or failed to activate his camera during enforcement activity. 

One January 2025 incident described a traffic stop involving a wanted subject who resisted arrest and where a use-of-force incident occurred. Supervisors later discovered there was no body-camera footage. An equipment check determined the camera was functioning properly and had not been charging or activated until minutes before the stop. Additional incidents in July 2025 documented Garza activating his camera several minutes into a high-risk call, using another deputy’s body camera while leaving that deputy without one, and responding to supervisory directives in an argumentative manner, including stating in an email that he would continue leaving his camera docked until a written policy was issued. 

DWI and Weapons Arrest After Separation

In the early morning hours of December 24, 2025, approximately one day after his separation became effective, Garza was arrested following a traffic stop near U.S. Highway 181 North and Eagle Ridge Drive in Floresville. According to a Wilson County Sheriff’s Office incident report, Garza was charged with Driving While Intoxicated with an Open Alcohol Container, a violation of Texas Penal Code §49.04(c). 

The same incident report lists an additional charge of Unlawful Carrying of a Weapon under Texas Penal Code §46.02. Evidence logged in the case included a firearm recovered from Garza’s vehicle and a blood kit collected as part of the investigation.

TCOLE History and Licensing Status

TCOLE records show Garza’s law-enforcement career includes service with the Bexar County Sheriff’s Office, first as a jailer beginning in 2017 and later as a peace officer from 2021 to 2022. He joined the Wilson County Sheriff’s Office as a peace officer on August 21, 2023, with his service ending on December 23, 2025.
