On December 29, 2023, Romana Gallegos filed a federal lawsuit against U.S. Marshal Max Hernandez and the Victoria Police Department in relation to the shooting and killing of her unarmed son, Javier “JD” Lane. The lawsuit alleges that on January 5, 2022, JD was fatally shot in the back by U.S. Marshal Max Hernandez after running, unarmed, from a traffic stop towards a large, open field.

According to the lawsuit, defendants failed to provide any first aid to JD despite knowing that he was unarmed and not a threat. Furthermore, JD Lane never had the opportunity to stand trial, as he was reportedly deemed guilty and given the death penalty by U.S. Marshal Max Hernandez.

The lawsuit also references a series of events preceding the fatal shooting, including robberies and incidents involving descriptions of individuals matching JD’s ethnicity. These events culminated in the shooting of JD, who was found with a small pipe-scraper in his hand. The lawsuit challenges Hernandez’s claim of seeing a “silver metallic object” in JD’s hand before the fatal shot, labeling this claim as dubious.

Lawsuit Accuses US Marshall in Texas of Failing to Render Aid

Furthermore, the lawsuit alleges that Hernandez and other defendants did not render first aid or attempt to save JD after the shooting. It is also stated that efforts by a nearby nurse to provide first aid were discouraged, and emergency medical services were reportedly unable to help JD upon their arrival.

As a result of the defendants’ actions, JD Lane is no longer alive, and his mother, Romana Gallegos, now suffers emotional injury, pain, and suffering, having been deprived of witnessing her son’s life. The lawsuit seeks punitive damages, asserting that the defendants’ acts were reckless, willful, wanton, and malicious.

The defendants have not yet publicly commented on the lawsuit.
