“Are You F—ing Stupid?” SAPD Officer Suspended Over DWI Arrest Incident

A San Antonio Police Department (SAPD) officer has been suspended without pay for three days after failing to follow department procedures during the June 13, 2024, arrest of a fellow officer on a Driving While Intoxicated (DWI) charge.

Officer Kristina O. Cobarrubias, a four-year veteran of the SAPD, agreed to the disciplinary action following an internal affairs investigation into her conduct at the scene of Officer Damean Segovia’s DWI arrest. The agreed suspension, finalized by Police Chief William P. McManus, was in effect from December 7 to December 9, 2024.

Incident Details and Investigation Findings

The incident in question occurred in the early morning hours of June 13, 2024, when University of Texas at San Antonio (UTSA) Police responded to a vehicle crash at N Loop 1604 West and Babcock Road. Upon arrival, UTSA officers identified SAPD Officer Damean Segovia as one of the involved drivers and subsequently arrested him for first-time DWI under Texas Penal Code Section 49.04.

According to SAPD’s Internal Affairs report (IA2024-0987), Officer Cobarrubias, who was on duty at the time, arrived at the scene after being informed of Officer Segovia’s arrest. Body-worn camera footage revealed that she approached the arresting officers and requested to speak with Segovia, who was seated in a patrol car. Officer Cobarrubias was granted permission but proceeded to ask Officer Segovia, “Are you f—ing stupid?”

UTSA Sergeant Ralph, who was overseeing the scene, later reported that she was “disappointed” with Officer Cobarrubias’ request to speak with Segovia. She stated that the request placed undue pressure on the handling officers and could have negatively impacted the integrity of the case, particularly if the incident proceeded to court.

Further, the investigation found that Officer Cobarrubias violated SAPD policies by failing to activate her body-worn camera upon arrival, as required under General Manual Rule 410.06. She also failed to notify a supervisor before leaving the scene, which is mandated in cases involving other officers.

Policy Violations and Suspension Agreement

Following the internal investigation, SAPD determined that Officer Cobarrubias violated multiple departmental policies, including:

Failure to notify a supervisor about an incident involving an SAPD officer before leaving the scene.

Failure to use sound judgment in her interaction with Officer Segovia.

Failure to activate her body-worn camera upon responding to a call for service.

These actions were deemed a violation of SAPD’s Rules and Regulations, particularly Section 3.04, which requires officers to perform their duties with honesty, sincerity, courage, and sound judgment. Additionally, she was found to have violated the San Antonio Fire Fighters’ and Police Officers’ Civil Service Commission Rules, under the provision of conduct prejudicial to good order.

Per the agreed suspension terms, Officer Cobarrubias waived her right to appeal the disciplinary action, and no administrative or judicial body has the authority to review or alter the suspension.

Officer’s Background and Training

Officer Cobarrubias has been with the SAPD since May 2020 and holds an active Peace Officer License. According to records from the Texas Commission on Law Enforcement (TCOLE), she has completed extensive training, including courses on police administration, mental health crisis response, and de-escalation techniques.
