Michelle A. Pelkey has filed a lawsuit against City of Midland Police Officer David Laborde and unknown Midland County Sheriff’s Office Central Detention Center employees, alleging violations of her civil rights. The lawsuit stems from an incident on the night of March 9, 2023, when officers responded to a domestic violence report at 3320 West Dengar Avenue, Midland, Texas.

According to the complaint, officers David Laborde, L. Johnson, and F. Josie encountered Timothy McCammon at a nearby location, where he alleged that Michelle Pelkey, heavily intoxicated, had been violent towards him and damaged his property. McCammon also claimed that Pelkey had a restraining order against him and that he had removed himself from the premises, believing Pelkey was still at his house.

Upon locating Pelkey at the address, officers allegedly approached her with weapons drawn, ordered her out of her vehicle, and placed her in handcuffs. Pelkey informed the officers that her daughter had remotely unlocked her pickup truck to allow her to escape from McCammon, who had threatened her. Despite Pelkey’s explanations, the officers did not enter the house to verify McCammon’s allegations or search for evidence.

As Pelkey was being escorted to a police vehicle, she repeatedly emphasized that she was still connected to her daughter through her Apple watch and had accessed OnStar to unlock the truck’s doors. Officers inquired about her alcohol consumption, to which Pelkey responded that her drink had been spiked with Xanax without her knowledge by McCammon. At this point, Officer Laborde allegedly conducted a physical search on Pelkey without her consent, leading to a distressing encounter where Pelkey was forcefully pushed into the police vehicle.

During the ensuing interaction with McCammon, it was reported that there was no restraining order against Pelkey. Despite this revelation, Pelkey was kept handcuffed in the vehicle, and her pleas for medical attention were allegedly ignored. Subsequently, she was transported to the Midland County Sheriff’s Office Central Detention Center, where her requests for medical help continued to be disregarded.

Pelkey’s suffering extended beyond the initial incident, as she was diagnosed with a fractured occipital bone and traumatic brain injury upon her release the next morning. Despite compliance with medical advice, her injuries have led to chronic pain, difficulty in daily activities, and ongoing health issues, ultimately forcing her to take a leave of absence from work and relocate out of state.

In addition to the physical and emotional toll, Pelkey has incurred significant medical expenses and faces challenges in securing employment due to the publicly available criminal record resulting from the incident. The complaint also highlights the alleged dismissive handling of Pelkey’s excessive force complaint against Officer Laborde by the City Police Department.

This lawsuit seeks to address the alleged violations of Pelkey’s civil rights, the use of excessive force, the lack of medical attention, and the subsequent impact on her health and livelihood.

The City of Midland, the Midland Police Department, and the Midland County Sheriff’s Office have yet to issue a public statement regarding these allegations. The case is set to unfold in the coming months as the legal proceedings progress.
