Arrested Howard County Justice of Peace is a Big Spring Reserve Officer

A recent request to the Texas Commission on Law Enforcement (TCOLE) has resulting in new information about Robert F Fitzgibbons.

It appears Fitzgibbons is not only a Justice of the Peace for Howard County, but is also a Reserve Officer for the Big Spring Police Department.

Fitzgibbons separated his full time peace officer license with the City of Big Spring on December 15, 2014. On or about February 5, 2015, Fitzgibbons has had his license held by the City of Big Spring in the rol of Reserve Peace Officer.

We are unsure if TCOLE has been provided with the Criminal Charge Notification, commonly referred to as the E-1 form.

Per Texas Administrative Code (TAC) 37, Part 7, Section 211.29(n), the Agency Administrator must do the following:

“An agency shall notify the commission electronically within 30 days, when it receives information that a person under appointment with that agency has been arrested, charged, indicted, or convicted for any offense above a Class C misdemeanor, or for any Class C misdemeanor involving the duties and responsibilities of office or family violence.”

We have submitted an inquiry to the Chief of Police for Big Spring and are waiting to hear back.
