On April 13, 2021, the Hays County 274th District Court held a hearing on a pre-indictment habeas corpus relief hearing. In the hearing the Travis County Attorney, Pro Tem disclosed the matter to be considered a misdemeanor and not a felony.

Apparently, per the Travis County Attorney, the Hays County “misfiled,” the warrant as a “felony stalking,” case. This simple oversight seems to indicated the use of a pseudonym was also a “simple oversight.”

Since October 1, 2018, the Kyle Police Chief Jeff Barnett has been using “John Smith,” as his alias when really; legally, he should have been using Jeffrey Blake Barnett.
We have to ask, what kind of Police Chief would make such a simple mistake? Would it be one that is trying to cover up his past conduct? Hence a Federal Lawsuit filed on Mr. Barnett.
It also raises another question. Why didn’t the Justice of Peace file the cause into her venue? This seems like a planned matter.
In any case, the Hays County District Attorney’s Office recused themselves in October 1, 2020 and it is in the hands of the Travis County Attorney to decide what case, if any exists.

In closure, as we have published before, one can lawfully say that Jeffrey Blake Barnett filed a charge of harassment and used his own office to orchestrate the investigation and arrest. His name is not protected from disclosure.
