Hays County Deputy Constable Gets 3 Reprimands in One Year
We recently requested the disciplinary actions for Hays County law enforcement personnel. On February 27, 2023, the Hays County Government released the disciplinary actions for the 2022 calendar year.
In review of the documents presented through the Texas Public Information Act (TPIA), it appears the Hays County Constable for Precinct 1 had reprimanded one Deputy Constable three times in the calendar year.
Hays County Deputy Constable Reprimanded in February 2022
On 02/16/2022, I (Chief Deputy Mike Varela) was notified by Deputy Brad Follis # 8083 who informed me that Deputy Darrell Perez #9203 was not following through with his duties as a bailiff.
Part of the Deputy Constable Bailiff’s duties and assignments are to fold letters and stuff envelopes ot notify the attorneys and citizens when to appear in court.
On 01-15-2022 Deputy Perez clocked in at 6:53 am and was sitting at his desk at approximately 7:30 am. When Deputy Leia Boggs #9232 arrived at approximately 7:30am, she noticed the stack of letters on the printer, Deputy Boggs asked Deputy Perez if he noticed the large stack of letters on the printer Deputy Perez response was “I’m not doing them right now”
Deputy Perez and I have had several discusses on his attitude, demeanor and work ethic in the past several months. Deputy Perez sometime appears to be lazy, comes off as having a does not want to be here attitude, fails to communicate with co-workers and/or Judges and disappears.
While discussing the above issue with Deputy Perez, he stated he may have been reading/homework that morning. I explained to Deputy Perez that while at work on the clock his jobs comes first and duty assignments must be completed. He is to check with the other bailiffs to see if they need any assistance before taking any breaks at which time he could catch up on reading/homework. Deputy Perez stated he understood and get back on track

Hays County Deputy Constable Reprimanded in August 2022
On 07/19/2022, I (Chief Deputy Mike Varela) was notified by Constable David Peterson who informed me that Deputy Darrell Perez #9203 was not following through with his duties as a bailiff again.
Constable Peterson stated that he was approached by a couple of the CCAL Judges who stated that they were not happy with Deputy D. Perez’s work ethic/performance. Upon further investigation by Lt. Law who spoke with Judge O’Brien, Lt. Law advised that one of the issues was a lack of communication on Deputy Perez’s part. The Judge went on to say that Deputy Perez tends to disappear a lot and the Judge doesn’t know where he is. Judge gave an example: Deputy Perez left but did advised Deputy Boggs that he was going to the vehicle maintenance shop, but Deputy Perez didn’t inform the Judge.
The Judge went on to say they were in a Jury Trail and Deputy Perez was sitting next to the jurors drinking coffee and on his cell phone which the Judge stated he could tell from the bench it was very distracting to the everyone in the courtroom and didn’t feel that Deputy Perez was using the best safety practices in the courtroom and that he appeared distracted.
Deputy Perez and I have had several discusses on his attitude, demeanor and work ethic in the past several months and was given a Written Warning on 01/17/22 for the following: Deputy Perez sometime appears to be lazy, comes off as having a does not want to be here attitude, fails to communicate with co-workers and/or Judges and disappears.
While discussing the above issue with Deputy Perez, he stated he may have been reading something on his cell and he could see now how that could be distracting. I explained to Deputy Perez it was okay to read a quick text and respond but not okay to watch programs, read stories or do homework.
Lt. Law and I explained to Deputy Perez he was going to be reassigned to the Courthouse next week to put him in a setting and which will give him an opportunity to improve his work ethic and communication skills.
We also explained to Deputy Perez that Lt. Law would train him on his new assignment and went over some his new job duties: Opening and Closing the Courthouse, Security, Enforcing Parking, Bailiff Commissioner’s and Constitutional Court’s that are held there at location.
[Deputy Perez disagreed] with the Supervisor’s Statement and wrote the following “I advised to the supervisors that my communication with the judge is minimal due to always being in my cubicle and not anywhere around the judge when not in court. Front staff always knows where I am.”

Hays County Deputy Constable Reprimanded in November 2022
On 11/04/2022, I (Chief Deputy Mike Varela) was notified by Judges Updegrove and Johnson by text requesting to meet with Constable David Peterson and Myself. When we arrived, both judges and Deputy Follis informed us that they had some issues with Deputy Darrel Perez #9203. Judges Updegrove and Johnson stated that Deputy Perez was eating others food without their permission, not pulling his weight and still disappearing and no one knows where he was at. The examples given where he would see a box of unopen chips under someone’s desk and he would just open the box and help himself and same with food in the break room, there would be a stack of letters that needed to mail out and he would wait for someone else to do them (even though those are time sensitive and need to be mailed out as soon as possible to notify attorneys and defendants of their court dates). Both judges then stated what really did it was that Deputy Perez apparently heard “Gigi” (a clerk) telling a story about a phone conversation and as Gigi walked off Deputy Perez was overheard in “spanish” saying “shut the h[*]ll up, f[**]king old lady” under his breath, at which point Deputy Perez was confronted by Paty Gomez and told him “to go tell her that to her face”. Ms. Gomez stated that Deputy Perez looked and acted shocked, but nothing else was said.
11/04/2022, Deputy D. Perez was notified that we received some information that was unsettling and we were waiting on more information which we hoped to have sometime next week. But in the meantime, he was going to be reassigned to the Couthouse as previous discussed do to his last written reprimand. We asked Deputy Perez if there was anything he wanted to tell us? Deputy Perez replied, “No.”
About an hour later Deputy Perez came to my office and asked why he was being reassigned. I informed him that we are getting some of the same complaints as of before”not doing letters and disappearing” he asked if he should be worried at which time, I explained to him we were waiting on more information and that we would talk about it next week.
Deputy Perez and I have had several discusses previously on his attitude, demeanor and work ethic in the past several months and was given a Written Warnings on 02/23/2022 & 08/01/22 for the following: Deputy Perez sometime appears to be lazy, comes off as having a does not want to be here attitude, fails to communicate with co-workers and/or Judges and disappears.
Deputy Perez stated on 02/23/2022, he appreciates the feedback and states that he is willing to work on the following:
– Communication with co-workers and judges
– Will check with the other bailiffs when he is finish with court and/or assigned duties to see if he can assist them with anything.
– Will stay on top of the letters.
– And will have a better work ethic/demeanor.Deputy Perez stated on 08/01/2022, he understood and appreciates the feedback and stated the following:
– He felt that he had been communicating better with co-workers and judges but understands – As far as his new assignment, he welcomed it and apologized for putting us is this situation.[Deputy Perez agreed] with the Supervisor’s Statement.
