Starr County, Texas Abortion Leads to Lawsuit
Lizelle Gonzalez has taken a stand against alleged violations of her constitutional rights involving the Texas abortion law.. This saga has unfolded in the United States District Court for the Southern District of Texas, where Lizelle filed a civil rights action against District Attorney Gocha Allen Ramirez, Assistant District Attorney Alexandria Lynn Barrera, and Starr County, Texas. The lawsuit invokes 42 U.S.C § 1983 and alleges infringements of the United States Constitution and federal laws.
At the heart of this legal turmoil lies a series of events surrounding Lizelle’s medical treatment and subsequent arrest. Beginning with a visit to the Starr County Memorial Hospital in January 2022, the situation escalated dramatically as Lizelle found herself embroiled in a controversy that reverberated throughout the community and garnered significant media attention. Through her lawsuit, Lizelle seeks not only to redress the harm she has suffered but also to hold accountable those whom she accuses of violating her rights.
This compelling narrative encompasses alleged privacy violations, an arrest, and the profound impact of these events on Lizelle’s life. Starr County, Texas Resident Has Abortion
On January 7, 2022, at approximately 7:18p.m., Lizelle Gonzalez, presented to the Starr County Memorial Hospital Emergency Department at 19 weeks gestational age with a claim of “abortion attempt” after using Cytotec Icetrogen 400 mcg in an alleged effort to induce an abortion. She was treated by Dr. Rodolfo Lozano, M.D. and Norma Aguirre RN. Following an obstetrical examination, which revealed no contractions and a positive fetal heart rate, Lizelle Gonzalez was discharged home on January 8, 2022, at 12:00 p.m. with a diagnosis of abdominal pain and instructions to follow up with Dr. Lozano on January 12, 2022. However, shortly after discharge, at around 12:40 p.m. on January 8, 2022, Lizelle was taken to Starr County Memorial Hospital via EMS with complaints of abdominal pain and vaginal bleeding. Examination in the emergency department revealed no fetal cardiac activity and an “incomplete spontaneous abortion.” As a result, Lizelle was admitted to obstetrics for a repeat classical cesarean section by Dr. Luis Ramirez for the delivery of her stillborn child.
Subsequently, between January 7, 2022, and March 30, 2022, employees, agents, and/or representatives of Starr County Memorial Hospital allegedly reported Lizelle’s self-induced abortion, in violation of federal privacy laws, to the Starr County District Attorney’s Office. The District Attorney’s Office, through its assistant district attorney, Alexandria Lynn Barrera, and its policy-maker Gocha Allen Ramirez, initiated an investigation and pursued charges of murder against Lizelle based on reports from hospital personnel. This led to Lizelle being arrested on April 7, 2022, and subsequently released on April 9, 2022, when the charges were dismissed. The fallout from these actions has had a lasting impact on Lizelle’s life, with extensive media coverage that has permanently affected her standing in the community.
Starr County, Texas Resident Files Lawsuit
In response to these events, Lizelle Gonzalez filed a lawsuit against Gocha Allen Ramirez, Alexandria Lynn Barrera, and Starr County, alleging violations of her rights secured under the Constitution and Laws of the United States, as a result of their unconstitutional actions. As a result of the Defendants’ conduct, Lizelle contends that she suffered humiliation, publicized indictment and arrest, and overall harm to her reputation and well-being. The lawsuit aims not only to vindicate her rights but also to hold accountable the government officials who violated them.
Starr County, Texas District Attorney Disciplined by State Bar of Texas
Moreover, on January 25, 2024, Gocha Allen Ramirez agreed to an Agreed Judgement of Probated Suspension with the Investigatory Panel 12-2 District 12 for his violations of the Texas Disciplinary Rules of Professional Conduct in prosecuting Lizelle for acts that were allegedly not criminal under existing state law.
