Starr County Lawsuit Unveils Alleged Abuse of Power and Mistreatment

On April 25, 2024, a lawsuit was filed in the United States District Court for the Southern District of Texas, McAllen Division, pertaining to an incident that occurred on or approximately May 12, 2023. The plaintiff, Marian Garcia, was at home in Rio Grande City, Texas, when her grandson, Jose Bazan, Jr., a 20-year-old autistic and disabled man, arrived home in a state of distress.

According to the lawsuit, Jose Bazan, Jr., had been recording an incident involving the Rio Grande City Police Department and the Starr County, Texas High Intensity Drug Trafficking Area Task Force with his cell phone. Allegedly, Officer Gerardo Gonzalez of the High Intensity Drug Trafficking Area Task Force yelled at Jose Bazan, Jr., causing him to run home in fear. Marian Garcia, who was outside at the time, confronted Officer Gonzalez and informed him of her grandson’s disability, seeking an explanation for his actions. The lawsuit alleges that Officer Gonzalez disregarded her inquiries, proceeded onto the property without permission, and physically assaulted Marian Garcia, causing her bodily harm and emotional distress.

The lawsuit further claims that Officer Gonzalez took Jose Bazan, Jr. into custody, and later detained both him and Marian Garcia at the HIDTA office for the entire day, without reading them their Miranda rights. It is alleged that both individuals sustained injuries as a result of unnecessary and excessive force used by Officer Gonzalez, resulting in the need for medical attention.

Additionally, the lawsuit states that Officer Gonzalez charged Marian Garcia with resisting arrest and interference with public duties, allegations that were reportedly dismissed after a video of the incident demonstrated otherwise.

Allegations of mistreatment, disregard for Miranda rights, unnecessary use of force, and the subsequent injuries and emotional distress experienced by the plaintiffs are central to the lawsuit filed against Officer Gerardo Gonzalez. Both Marian Garcia and Jose Bazan, Jr. seek legal redress for the alleged injustices they suffered.
