A lawsuit was recently filed in the District Court of Travis County against the Texas Parks & Wildlife Department (TPWD) and the commission following their authorization to convey 43 acres of Boca Chica State Park land to SpaceX. This contentious decision, made in exchange for 477 acres of corporation-owned land, has sparked outcry from local organizations including the South Texas Environmental Justice Network, Carrizo Comecrudo Tribe of Texas, and Save RGV. Represented by Marisa Perales of Perales, Allmon & Ice, P.C., these organizations have come together to challenge the TPWD’s decision, which they argue is not in the public interest.

Attorney Marisa Perales, speaking on behalf of the Rio Grande Valley organizations, expressed concern over TPWD’s failure to uphold its obligation to protect park land and wildlife resources. The lawsuit alleges that the authorization of the conveyance of public park land to SpaceX violates statutory requirements, including the need to consider alternatives, minimize harm to the park land, and prioritize the best interests of the local community and TPWD.

Residents of the Rio Grande Valley have long been vocal about the adverse impact of SpaceX’s operations, citing issues such as restricted access to HWY 4, hindrance of cultural ceremonies for the Carrizo/Comecrudo Tribe, destruction of wildlife habitats, and public safety threats. The latest move by SpaceX to acquire public park land has further aggravated these concerns, prompting strong opposition from local residents and environmental experts. The TPWD’s decision, in contrast to the sentiments of the majority, has raised questions about its dismissal of public input and local community concerns.

Highlighting the cultural significance of the Boca Chica Beach and its surroundings, Christopher Basaldú, Ph.D. of South Texas Environmental Justice Network, emphasized the need to preserve this untouched coastal area and condemned the lack of consultation with the Carrizo Comecrudo Tribe of Texas before the land’s conveyance to SpaceX.

Echoing these sentiments, Tribal Chairman Juan Mancias stressed the sacred nature of the land to the tribe and criticized TPWD for considering the transfer of land without consultation, which he believes disregards the cultural and historical significance of the area.

With the lawsuit now in motion, the South Texas Environmental Justice Network, Carrizo Comecrudo Tribe of Texas, and Save RGV, supported by legal representation from Perales, Allmon & Ice, P.C., seek to challenge the TPWD’s decision and protect the interests of the community and the integrity of Boca Chica Beach and its surrounding environment.
