District Attorney José Garza has announced a partnership with key figures in Travis County for the upcoming Expunction Expo on Saturday, April 27, 2024. This initiative aims to assist individuals in clearing their records if they were arrested but never convicted of a crime. Clearing arrest records can significantly improve opportunities for employment, housing, and educational financial aid, ultimately fostering stability within the community and enhancing safety for all residents.
Expunction: Clearing the Path Forward
The Expunction Expo is an event designed to help Travis County residents clear their old arrest records. Not all arrests qualify for clearing, but exploring the possibility is often beneficial. Individuals with arrest records often face challenges in obtaining jobs, housing, or financial aid for college. The process of clearing an arrest record, known as “expunction” in Texas, is essential for creating a more equitable and opportunity-rich environment.
Partner Organizations and Legal Support
The 2024 Expunction Expo is supported by various organizations committed to helping Travis County residents determine if their records qualify for expunctions. The partnering entities include the Travis County District Attorney’s Office, Travis County Attorney’s Office, Travis County District Clerk’s Office, in addition to legal services provided by Capital Area Private Defender Service (CAPDS), Travis County Public Defender’s Office, Volunteer Legal Services (VLS), and the Travis County Law Library.
Understanding Eligibility for Expunction
It is crucial for individuals to understand the eligibility criteria as per Texas law. Only Travis County crimes can be considered for expunction at this Expo. According to the law, a case may qualify for expunction if any of the following conditions apply:
- The charge was never filed or was no billed by the grand jury.
- A criminal charge was dismissed.
- A diversion program, such as Pretrial Diversion or Drug Court, was successfully completed.
- The individual was acquitted on the charge by a judge or jury, or later pardoned by the Governor of Texas or the President of the United States.
